Terms of Service
These Terms of Service ("Terms") govern your access to and use of the Arc Labs website, platform, and services (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
1. Eligibility
You must be at least 18 years old and legally authorized to cultivate cannabis in your jurisdiction to use the Services. By using the Services, you represent and warrant that you meet these requirements. ARC Labs reserves the right to verify your age and licensing status.
2. Accounts
To access certain features, you must create an account. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activity that occurs under your account
- Notifying us immediately of any unauthorized access or security breach
- Ensuring your account information is accurate and up to date
We reserve the right to suspend or terminate accounts that violate these Terms or remain inactive for more than 12 months.
3. Acceptable Use
You agree not to:
- Use the Services for any illegal purpose or in violation of any laws
- Attempt to gain unauthorized access to any part of the Services
- Interfere with or disrupt the Services or servers
- Use automated means (bots, scrapers) to access the Services without permission
- Upload malicious code, viruses, or harmful content
- Share your account credentials with unauthorized users
4. Intellectual Property
The Services and all content, features, and functionality are owned by ARC Labs and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Services for their intended purpose. This license does not permit resale, redistribution, or creation of derivative works.
5. Your Data
You retain ownership of your cultivation data. By using the Services, you grant ARC Labs a license to store, process, and display your data solely for the purpose of providing the Services. We will not use your data for purposes outside of operating the platform without your explicit consent.
6. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access. The Services may be temporarily unavailable for maintenance, updates, or factors beyond our control. We will make reasonable efforts to notify users of planned downtime.
7. Termination
You may terminate your account at any time by contacting us. We may suspend or terminate your access if you violate these Terms or if required by law. Upon termination, your data will be retained for 30 days then permanently deleted, unless legal obligations require longer retention.
8. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. ARC Labs does not warrant that the Services will be error-free, secure, or meet your specific requirements. Cultivation decisions based on platform data or recommendations are your sole responsibility.
9. Limitation of Liability
To the maximum extent permitted by law, ARC Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services. Our total liability shall not exceed the amount you paid for the Services in the 12 months preceding the claim, or $100 if no payment was made.
10. Governing Law
These Terms shall be governed by the laws of the State of Oklahoma, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Oklahoma County, Oklahoma.
11. Changes to Terms
We may modify these Terms at any time. Changes will be posted on this page with an updated date. Continued use of the Services after changes constitutes acceptance. Material changes will be notified via email.
